As present terms and conditions of sale regulate the contractual terms and obligations applicable to the reservation and execution of passenger transport services (transfers) provided by Caminhos Perfumados, Lda., with the tax identification number 518187039 and headquartered at Estrada de Santa Eulália nº21, 8200-269 Albufeira.
By making a reservation on our website, by email or by phone, the customer accepts and binds themselves, without reservations, to the following conditions:
1. Reservation and Confirmation Process
Reservation Request: The customer must provide all requested data correctly (name, email, phone, date, time, flight number, pickup location, and destination).
Travel Voucher: The reservation is only considered confirmed and binding after Caminhos Perfumados, Lda. sends the respective confirmation voucher by email.
Data Verification: It is the customer's sole responsibility to verify all details contained in the voucher. Any errors must be communicated immediately.
2. Flight Delay Monitoring and Tolerance Monitoring: Caminhos Perfumados, Lda. monitors flight schedules based on the flight number provided by the customer during the reservation.
Free Tolerance Time: The driver will wait at the airport for up to 60 minutes after the customer's flight's actual landing time.
Delays Exceeding 60 Minutes: If the customer is detained at baggage claim or customs for more than 60 minutes, they must contact the company through phone +351 289 013 835. If there is no contact, the driver will leave the location after the tolerance period, and the service will be considered a "No-Show" without the right to a refund.
Prolonged Delays or Flight Divertions: If the flight is delayed by more than 2 hours or diverted to another airport, Caminhos Perfumados, Lda. will make every effort to reschedule the transfer according to fleet availability. If it is not possible to reassign the service, the reservation will be canceled, and the paid amount will be fully refunded to the customer.
3. Baggage and Special Transport Policy Standard Allowance: Each passenger is entitled to transport 1 checked bag and 1 carry-on bag standard.
Additional or Special Baggage: The transport of oversized baggage (such as surfboards, golf bags, bicycles, or additional baby strollers) must be declared at the time of reservation.
Transport Refusal: The company reserves the right to refuse the transport of baggage that exceeds agreed limits and cannot fit safely in the allocated vehicle's baggage compartment, without any right to a refund or compensation.
4. Cancellations, Changes, and Refunds Customer Cancellations:
Up to 24 hours before the start of the service: Cancellation is free, and the customer receives a full refund of the paid amount (minus any bank processing fees).
Less than 24 hours in advance or No-Show: There will be no refund, and the customer will be charged the full service amount.
Reservation Changes: Requests for changes to dates, times, or routes must be made with a minimum of 24 hours' notice and are subject to fleet availability and potential fare adjustments.
Company Cancellations: In case of force majeure (such as extreme weather conditions, general strikes, or unforeseen mechanical failures), Caminhos Perfumados, Lda. may cancel the service, ensuring the total and immediate refund of paid amounts, without the customer having the right to additional compensation.
5. Safety, Baby Seats, and Passenger Conduct Baby/Child Seats: According to Portuguese legislation (Article 55 of the Highway Code), the transport of children requires approved restraint systems. The customer must request necessary seats or elevators at the time of reservation.
State of Intoxication or Improper Conduct: The driver reserves the right to refuse the transport of any passenger under the influence of alcohol, drugs, or exhibiting aggressive behavior that puts the safety of the driver, vehicle, or other passengers at risk. In such cases, the service is canceled without a refund.
Prohibitions: It is strictly forbidden to smoke (including electronic cigarettes) and consume alcoholic beverages or food inside the vehicles.
6. Applicable Law and Alternative Dispute Resolution (ADR) These conditions are governed by Portuguese law.
In case of a consumer dispute, the customer can resort to Consumer Alternative Dispute Resolution Entities. For services provided in the Algarve region, the competent entity is the CIMAAL – Algarve Consumer Conflict Information, Mediation, and Arbitration Center (www.consumoalgarve.pt).
7. Liability and Insurance
7.1. Coverage and Mandatory Insurance:Caminhos Perfumados, Lda. ensures that all its vehicles and transport services operate in full compliance with applicable Portuguese legislation. The activity is properly safeguarded by mandatory insurance policies, including:Automobile Liability Insurance: Covers material and personal damages caused to third parties and passengers transported inside the vehicles in case of a road accident.
Personal Accident and Activity Insurance: Guarantees coverage of risks of death, permanent disability, and treatment or repatriation expenses resulting from the activity, in accordance with the minimum capital required by law for tourist passenger transport. [1, 2, 3]
7.2. Exclusion of Liability for Delays:Caminhos Perfumados, Lda. cannot be held responsible for delays, non-compliance, or missed connections of third-party transports (such as flights or trains) resulting from force majeure or unforeseeable circumstances beyond its direct control, such as:Extreme weather conditions or natural disasters.
Anomalous traffic congestion, accidents on public roads that block circulation, or unsignaled construction.
General strikes, protests, demonstrations, or exceptional border/police checks.
Sudden and unforeseen mechanical failures in the vehicle (in which case the company will immediately activate a replacement vehicle with the greatest possible urgency).
7.3. Damage and Theft of Baggage:Personal belongings and passengers' baggage are transported under the responsibility of their owners. Caminhos Perfumados, Lda. does not assume responsibility for:Loss, theft, or deterioration of valuable objects placed in the trunk or left inside the vehicle.
Forgotten objects in vehicles. If lost objects are found after the service, they will be kept in the company's facilities for the legal period of 30 days, and the customer will bear the costs of retrieval or postal shipping. [1]
7.4. Damage Caused to the Vehicle:The customer (or whoever contracted the service on behalf of the group) will be directly and financially responsible for any damages, extreme dirtiness, or acts of vandalism deliberately or negligently caused inside or outside the vehicles of Caminhos Perfumados, Lda. The company reserves the right to charge the full costs of repair and the professional cleaning fee required to put the vehicle back into circulation.
